1. Acceptance of Terms
These Terms of Use govern your use of www.bhiwandimart.com and the BhiwandiMart mobile application. By accessing our services or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use our services.
2. Eligibility and Your Account
You must be at least 18 years old to place orders, or use our services under the supervision of a parent or legal guardian. Your mobile number identifies your account and is verified by OTP. Keep access to your mobile number secure — anyone who can receive your OTP can use your account. You are responsible for the accuracy of the details you provide, including your name, contact number and delivery address. You can delete your account at any time, as described in our Privacy Policy.
3. Orders and Pricing
Placing an order is an offer to buy the selected products. Prices, delivery charges and applicable taxes are shown before you place your order. We may decline or cancel an order if a product is unavailable, or if there is an obvious error in pricing or product information.
4. Payment
Payment is currently accepted by Cash on Delivery only. Please keep the order amount ready at the time of delivery.
5. Delivery
We currently deliver in Bhiwandi and Kalyan only. Delivery times shown are estimates and may vary due to factors outside our control.
6. Cancellations
You may cancel an order before it is shipped. Once shipped, it can no longer be cancelled. We may also cancel an order that we are unable to fulfil, and will inform you if we do.
7. Product Information
We strive to keep product details, images and pricing accurate, but errors may occasionally occur. We reserve the right to correct such errors.
8. Communications
By creating an account or placing an order, you agree to receive OTP messages and order updates by SMS and push notifications, as described in our Privacy Policy.
9. Privacy
Your use of our services is also governed by our Privacy Policy, which explains what personal data we collect, how we use it and with whom we share it.
10. Acceptable Use
You agree not to misuse our services, including by placing fraudulent orders, providing false information, attempting to gain unauthorised access to our systems, or using automated tools to copy content from our website or app.
11. Limitation of Liability
To the extent permitted by law, BhiwandiMart is not liable for indirect or consequential losses arising from your use of our services. Nothing in these Terms limits your rights under the Consumer Protection Act, 2019.
12. Governing Law
These Terms are governed by the laws of India. Any disputes are subject to the jurisdiction of the courts at Thane, Maharashtra.
13. Changes to These Terms
We may update these Terms from time to time. Continued use of our services after changes are posted means you accept the updated Terms.
